, . <br /> 0.777 acres, more or less, which exists as public road right-of-way, said <br /> perpetual right-of-way easement containing 0.963 acres, more or fess, <br /> said tract being also shown by the plat hereto attached and considered a <br /> part hereof. <br /> The Grantors further grant all trees, growths and road building materials within the <br /> public road right-of-way, together with the right to use the same in such a manner and at <br /> such locations as the Grantee may deem proper, needful or necessary, in the construction, <br /> reconstruction, improvement or maintenance of the highway. The Grantors, their successors <br /> and assigns, waive any claim for damages to the Grantors' remaining property contiguous to <br /> the public road right-of-way by reason of the location, construction, landscaping or <br /> maintenance of the highway. <br /> The Grantors further grant, cor�vey and dedicate to Grantee full right, power and <br /> authority to regulate and permit installa#ion of public and private utiiities and drains within the <br /> public road right-of-way. <br /> The Grantors further, as a part of this dedication, agree to remove any and all fences, <br /> enclosures, buildings and other obstructions from the public road right-of-way and to <br /> completely vacate same within thirty (30) days of the date of execution of this instrument or <br /> any highway authority of the county and 'rt's or their representatives, engineers, agents, <br /> contractors and employees are hereby authorized to enter into and take full and complete <br /> possession of said tract, and any fences, enclosures, buildings or other obstructions <br /> remaining thereon may be removed and the Grantors hereby waive all right of any damage <br /> caused thereby. <br /> The Grantors, without limiting the interest above granted and conveyed, do hereby <br /> acknowledge that upon payment of the agreed consideration, all claims arising out of the <br /> above acquisition have been settled, including any diminution in value to any remaining <br /> property of the Grantors caused by the opening, improving and using the above-described <br /> premises for highway purposes.
