G. The prospective primary participant further agrees by submitting this proposal that it will <br /> include this section and the Ineligible Contractors Certificate(see Appendix B),provided by the <br /> City and included with these specifications, without modification, in all lower tier covered <br /> transactions and in all solicitations for lower tier covered transactions. <br /> H. A participant in a covered transaction may rely upon a certification of a prospective <br /> participant in a lower tier covered transaction that it is not debarred,suspended,ineligible,or <br /> voluntarily excluded from the covered transaction, unless it knows that the certification is <br /> erroneous. Participant may decide that method and frequency by which it determines the <br /> eligibility of its principles. Each participant may, but is not required to, check the Non- <br /> Procurement List issued by U.S. General Services Administration. <br /> I. Nothing contained in the foregoing shall be construed to require establishment of a system <br /> of records in order to render in good faith the certification required by this clause. The <br /> knowledge and information of a participant are not required to exceed that which is normally <br /> possessed by a prudent person in the ordinary course of business dealings. <br /> J. Except for transactions authorized under Paragraph F of these instructions,if a participant <br /> in a covered transaction knowingly enters into a lower tier covered transaction with a person <br /> who is suspended, debarred, ineligible, or voluntarily excluded from participation in this <br /> transaction, in addition to all remedies available to the Federal Government, the City may <br /> pursue available remedies, including suspension and/or debarment. <br /> 2.0 PROHIBITED INTERESTS <br /> No member, or officer, or any employee of the City of Decatur or a local public body with <br /> financial interest or control in this contract, during their tenure or for one year thereafter, <br /> shall have any interest, direct or indirect, in this Agreement or the proceeds thereof. <br /> 3.0 INTEREST OF MEMBER OF OR DELEGATES TO CONGRESS <br /> No member of or delegate to the Congress of the United States or to the Illinois General <br /> Assembly shall be admitted to any share or part of this Agreement or to any benefit arising <br /> therefrom. <br /> 4.0 NON-COLLUSION <br /> The Contractor guarantees that the proposal it submitted is not a product of collusion with <br /> any other bidder and no effort has been made to fi�the proposal price of any bidder or to fix <br /> any overhead, profit or cost element of any proposal price. (see Appendix B). <br /> 5.0 EQUAL EMPLOYMENT OPPORTUNITY <br /> Contractor shall be required to comply with all applicable Equal Employment Opportunity <br /> laws and regulations. In connection with this project,the Contractor shall not discriminate <br /> against any employee or applicant for employment because of race, religion, color, sex, <br /> national origin or disability.
