, <br /> � , . <br /> LEGAL DEPARTMENT MEMORANDUM <br /> NO. 2005-14 <br /> May 31, 2005 <br /> TO: Honorable Mayor Osborne and City Council ' <br /> FROM: Steve Garm ity Manager ��/' <br /> Wendy Mort d, Corporation Counsel � <br /> , <br /> SUBJECT: Public Building Commission <br /> SUMMARY RECOMMENDATION: Staff recommends passage of the proposed <br /> Resolution approving the Allocation Agreement between the City, Macon County and <br /> the Decatur Public Building Commission. <br /> BACKGROUND: A request has been received to approve and execute the attached <br /> Allocation Agreement. This Resolution and Allocation Agreement are required so that <br /> the bond issue of the County will not count against the City's bond qualification since <br /> none of the property involved with the bond is part of the City. The City is required to <br /> do this because we appoint a majority of the members of the Public Building <br /> Commission and, therefore, are presumed to have control. This does not affect the <br /> City's ability to issue bonds should we have that need to do so in the future. <br /> POTENTIAL OBJECTIONS: There are no known or expected objections. <br /> INPUT FROM OTHER SOURCES: <br /> STAFF REFERENCE: Wendy Morthland, Corporation Counsel at 424-2807. <br /> BUDGET/TIME IMPLICATIONS: None <br />
