Excerpts from Plan Commission Minutes of December 3, 2015: <br /> Cal. No. 15-57 Petition of B & R DEVELOPMENT, LLP to rezone <br /> property located at 5285 EAST MARYLAND <br /> STREET from R-1 Single Family Residence <br /> District to M-1 Intense Commercial/Light Industrial <br /> District. <br /> Ms. Suzy Stickle was sworn in by Mrs. Janet Poland. <br /> Ms, Stickle presented the recommendation of staff: <br /> The subject site is approximately 7.39 acres and is located at 5285 East Maryland Street. The <br /> site is currently developed with a single family residential structure and two (2) accessory <br /> structures. <br /> The petitioner proposes to rezone from R-1 Single Family Residence District to M-1 Intense <br /> Commercial/Light Industrial District to allow for all those uses permitted in the M-1 Intense <br /> Commercial/Light Industrial District. <br /> The surrounding zoning includes M-1 Intense Commercial/Light Industrial District to the west <br /> and R-6 Multiple Dwelling District to the south. The Village of Long Creek is to the east and <br /> there is City ROW, State ROW and Railroad ROW to the north. The Macon County and <br /> Decatur Comprehensive Plan shows this area as Retail. The permitted land uses in the M-1 <br /> District are compatible with the land uses to the west, north and south and the zoning district to <br /> the west. <br /> Although the Comprehensive Plan shows this area as retail, staff is of the opinion that uses <br /> permitted in the M-1 District will not alter the essential character of the general area, <br /> If the property is rezoned to M-1 Intense Commercial/Light Industrial District and development <br /> occurs, the adjacent properties will have a buffer yard between the residential properties and the <br /> development in accordance with the regulations of the Zoning Ordinance. <br /> Staff recommends approval of the rezoning. <br /> Section XXIX. of the Ciiy of Decatur Zoning Ordinance requires the Plan Commission to hold a <br /> public hearing on a rezoning request, and then forward its report and recommendation to the City <br /> Council for final approval. A motion to forward Calendar Number 15-57 to the City Council <br /> with a recommendation for approval is suggested. <br /> Mr. Robert Cox, representative, was sworn in by Mrs. Poland. <br /> Mr. Cox stated the current plan for the property is to have a two (2) lot minor subdivision with <br /> plans for having a retail business on the front lot and some type of storage units on the rear lot. <br /> There were no questions and no objectors present. <br /> It was moved and seconded (Smith/Myatt) to forward Calendar No. 15-57 to the City Council <br /> with a recommendation for approval. Motion carried unanimously. <br />
