1 <br /> D. Termination of Project Funding <br /> The City reserves the right to suspend or terminate payment of reimbursement requests <br /> for a project in whole or in part for cause. Cause shall include the following: <br /> 1. Improper use of funds; <br /> 2. Failure to comply with the terms and conditions of this Agreement, including <br /> those specified in item C. above; <br /> 3. Failure to comply with HLTD program guidelines. <br /> The City shall notify DCRM before any such termination takes place and allow <br /> opportunity for review and correction of problems. <br /> E. Property Standards <br /> DCRM shall ensure that all housing it constructs or rehabilitates with HOME funds meets <br /> all applicable local codes, the 1997 Illinois Accessibility Code, HUD Housing Quality <br /> Standards (HQS), ordinances, and zoning ordinances at the time of project completion. <br /> Payout requests for work requiring mechanical, electrical, or plumbing inspections shall <br /> not be processed without documentation that the applicable permits have been received <br /> and required inspections conducted. <br /> VI. TECHNICAL ASSISTANCE <br /> The City shall provide technical assistance to DCRM upon request, at no additional cost, <br /> to guide the organization in the proper administration of the HOME funds. <br /> VII. NONDISCRIMINATION AND EQUAL ACCESS <br /> A. Affirmative Marketing <br /> DCRM agrees that it shall affirmatively market this project to all persons within its <br /> special needs population. DCRM will develop and adhere to an Affirmative Marketing <br /> plan which shall consist of actions to provide information and otherwise attract eligible <br /> persons in the housing market area to the project without regard to race, color, national <br /> origin, sex, religion, familial status or disability. The Affirmative Marketing plan shall be <br /> submitted to the City prior to the payout of any reimbursements requests under this <br /> Agreement. <br /> B. Fair Housing and Equal Opportunity <br /> DCRM agrees to comply with any applicable City and State Civil Rights ordinances and <br /> with Title VI of the Civil Rights Act of 1964 as amended, Title VIII of the Civil Rights <br /> Act of 1968 as amended, Section 109 of Title I of the Housing and Community <br /> Development Act of 1974, Section 504 of the Rehabilitation Act of 1973,the Americans <br /> with Disabilities Act of 1990, the Age Discrimination Act of 1975, Executive Order <br /> 11063, Executive Order 11246 as amended by Executive Orders 11375 and 12086, and <br /> with the Fair Housing Act (42 U.S.C. 3601-19). <br /> 4 <br />
