If Seller elects to terminate this Contract, then Buyer shall have ten (10) days after <br /> receiving Seller's termination notice to waive, in writing, given to Seller, the conditions set <br /> forth in this Paragraph 3.3, whereupon Seller's termination notice shall be void and this <br /> Contract shall continue. <br /> 3.4. Intentionaliy Left Blank. <br /> 3.5. If this Contract is terminated pursuant to this Paragraph 3 (which is not <br /> rendered void as described above) or pursuant to Paragraph 9 below, then the earr�est money <br /> shall be returned to Buyer, and both Seller and Buyer shall be released from ali liabilities and <br /> obligations under this Contract. <br /> 3.6. While this Contract is in effect, Sel(er shall (i) not enter into or amend any <br /> contracts, options, leases, easements or other agreements affecting the Property, (ii) make all <br /> payments and otherwise perform the obligations under any promissory note and mortgage or <br /> deed of trust which encumbers the Property, and (iii) not take any action which would <br /> adversely affect the ownership or condition of the Property. Seller shall fully cooperate with <br /> Buyer in Buyer's attempt to satisfy the conditions in Paragraph 3. <br /> 3.7. If any of the conditions in this Paragraph 3 change after having been <br /> satisfied or waived by Buyer and before this transaction is closed, then such condition(s) shall <br /> be reinstated as if having never been satisfied or waived by Buyer. <br /> 4. Closin�. If this Contract has not been terminated, this transaction shall be <br /> closed at the office of the Title Company thirty (30) days after Buyer gives Seller written <br /> notice that Buyer has obtained all of the Permits described in Paragraph 3.3 above or that <br /> Buyer waives the requirement of such Permits. <br /> 5. Survev. At Buyer's cost, Buyer may cause a Survey of the Property to be <br /> prepared by a registered land surveyor. <br /> 6. Title Commitment. At Seller's cost, Buyer shall obtain a current Title ! <br /> Commitment for an Owner's Title Insurance Policy for the Property issued by: � <br /> Title Company: Decatur Title Company <br /> Street Address: 145 S. Water St. <br /> City, State, Zip: Decatur, IL 62523 <br /> Seller shall pay all title examination fees or other expenses charged by the Title Company for <br /> the purpose of issuing such Title Commitment. <br /> 7. Seller's Closing Obligations. At the closing, <br /> (a) Seller shall deliver to Buyer or to such person or corporation as Buyer <br /> may nominate a general warranty deed, conveying the Properry in fee simple, free and clear of <br /> all encumbrances, defects, restrictions, conditions, easements or other agreements not <br /> approved by Buyer. <br /> (b) Seller shall cause to be paid in full and released of record all deeds of <br /> trust, mortgages, liens and encumbrances which are liens on the Property. <br /> (c) Seller shall execute, acknowledge and deliver to Buyer a certificate <br /> certifying to Buyer that all of the representations and warranties of Seller in this Contract are <br /> true and correct as of the date of closing. <br /> 3 <br />
