Anderson Plaza <br /> Decatur, IL 62523 <br /> The undersigned,"Grantors",for and in consideration of Three thousand nine hundred <br /> sixty dollars($3,960.00)as payment for the permanent and/or temporary easement and One <br /> thousand three hundred sixty five dollazs($ 1,365.00) as payment for damages on the permanent <br /> and/or temporary easement area, and other good and valuable consideration, receipt whereof is <br /> hereby acknowledged,conveys to the City of Decatur, Illinois, "City"a permanent easement in, <br /> over the following described real estate: <br /> A strip of land 15 feet in width extending over, through and across the Southeast �� <br /> Quarter of Section 23, in Township 17 North, Range 2 East of the 3`d PM, Macon County, ', <br /> Illinois, which lies North of Interstate Route 72, the centerline of the said 15 foot strip of I <br /> land being described as beginning on the West line of the said Southeast Quarter at a I� <br /> point 7.5 feet South of the South right of way line of Hickory Point Road extending along <br /> the North side thereof, thence East pazallel to the said South right of way line to a point <br /> of exit on the East line of the said Southeast Quarter, said point being 7.5 feet South of <br /> the said South right of way line of said Hickory Point Road, <br /> for constructing and maintaining a water pipeline project thereon, and to enter therein or thereon <br /> at such time or times as said City shall deem necessary; hereby releasing and waiving all rights <br /> under and by virtue of the Homestead exemption Laws of the State of Illinois. <br /> The undersi ed Grantor further ants to the said Ci , a tem or easement 15 feet in width <br /> � , g� h' P �5' <br />' lying South of and contiguous to the above described permanent easement. <br /> When excavating the trench in cultivated land the City of Decatur or its contractor shall use its <br /> best efforts to separate topsoil from subsoil. When backfilling the trench, the City or its <br /> contractor shall use its best efforts to replace the topsoil to the same depth that esisted prior to <br /> excavation the trench. City shall dispose excess subsoil in a manner reasonably specified by <br /> Grantor. <br /> The City shall inspect all tile lines intersecting the trench for their entire length within the <br /> easement and temporary easement area to identify damaged tile. Any tile determined by such <br /> inspection to have been damaged by construction of the waterline shall be repaired. <br />
