Staff has reviewed this request and considers the agreement with Maple Investments, LLC, for <br /> the restriction on a portion of the City's Grand Avenue right-of-way to be acceptable. The <br /> subsurface area beneath the affected portion of public right-of-way is not currently used nor does <br /> it represent a viable source of potable water because of its location and use. The Engineers <br /> reviewing the site have determined that ground water in the area should not be affected by the <br /> site contaminants and therefore are not requesting an ordinance restricting wells in the area. <br /> Some years ago, the Illinois Municipal Review carried an article written by an official with the <br /> Illinois Department of Transportation which adequately summarizes the need and benefits of <br /> TACO Agreements.
