16. This Agreement is entered into by the City in recognition of laws passed by the <br /> General Assembly and regulations adopted by the Pollution Control Board which <br /> encourage a tiered-approach to remediating environmental contamination. This <br /> Agreement is entered into by the City in the spirit ofthose laws and under its right <br /> and obligation as a highway authority. Should any provisions of this Agreement <br /> be struck down as beyond the authoriry of the City, however,this Agreement shall <br /> be null and void. <br />
