HP Water Pipeline Easement Tract #10, Schwarze PERMA1vENT and TEMPORARY EASEMENT Grantee: The City of Decatur, Illinois #1 G K. Anderson Plaza �'Y Decatur, IL 62523 , The undersigned, "Grantors",for and in consideration of Three thousand Six hundred Fifteen and no/100 dollars($3,615.00)as payment for the permanent and/or temporary easement and One thousand Sis Hundred Seventy and no/100 dollars ($ 1,670.00) as payment for damages on the permanent and/or temporary easement area, and other good and valuable consideration, receipt whereof is hereby acknowledged,conveys to the City of Decatur, Illinois,"City"a permanent easement in,over the following described real estate: A strip of land 15 and 30 feet in width extending over, through and across the �` Half of the Northwest Quarter and the West 60 acres of the Northeast Quarter in Section '', all in Township 17 North, Range 2 East of the 3`d PM, Macon County, Illinois, the centerli.ne of the said 15 foot strip of land beina described as beginning on the West line of the said East Half at a point 7.5 feet North of the North right of way line of Hickory Point Road extending along the South side thereof, thence East parallel to the said road right of way a distance of 600 feet, to a point where the easement strip widens to a width of 30 feet, being 7.5 feet South of the centerli.ne and 22.5 feet North of the centerline for a distance of 350 feet to a point where the easement strip is reduced to 15 feet, thence East to the point of exit on the East line of the said West 60 acres, said point being 7.5 feet North of the said right of way line, for constructing and maintaining a water pipeline project thereon, and to enter therein or thereon at such time or times as said City shall deem necessary; hereby releasing and waivin;all rights under and by virtue of the Homestead esemption Laws of the State of Illinois. The undersi�ed Grantor, further grants to the said City, a temporary easement 15 feet in width lying North of and contiguous to the above described permanent easement. When excavating the trench in cultivated land the City of Decatur or its contractor sha(1 use its best efforts to separate topsoil from subsoil. When backfilling the trench, the City or its contractor shall use its best efforts to replace the topsoil to the same depth that esisted prior to excavation the trench. City shall dispose excess subsoil in a manner reasonably specified by Gra.ntor. The City shall inspect all tile lines intersecting the trench for their entire length within the easement and temporary easement area to identify damaged tile. Any tile determined by such inspection to have been damaged by construction of the wateriine shall be repaired. 1
