The ENGINEER warrants that no person or selling agency has been employed or retained to solicit or secure this contract upon an agreement or understanding for a commission,percentage,brokerage,or contingent fee,excepting bonafide employees. For breach or violation of this warranty, the OWNER shall have the right to annul this AGREEMENT without liability or in its discretion to deduct from the contract price or consideration or otherwise recover,the full amount of such commission,per- centage, brokerage or contingent fee. g. The ENGINEER certifies that the services of anyone that has been debarred or suspended under federal Executive Order 12549 has not or will not be used for planning, design and construction. 3. Insurance- The ENGINEER shall procure and maintain, at its expense, insurance of the type and in the minimum amounts stated below: a. Worker's Compensation: Coverage A. Statutory Benefits Coverage B. Employers' Liability as follows: Bodily injury by accident $100,00 each accident Bodily injury by disease $500.00 policy limit Bodily injury by disease $100,000 each employee b. Commercial General Liability: Each Occurrence Limit $1,000,000 Personal Advertising Injury Limit $1,000,000 � Products/Completed Operation Aggregate Limit $2,000,000 General Aggregate Limit $2,000,000 c. Comprehensive Automobile Liability: Combined Single Limit, Each Accident $1,000,000 d. Architects & Engineers Professional Liability: Each Claim Limit $2,000,000 Aggregate Limit $2,000,000 e. Umbrella over above Items a., b. and c. $1,OOC�,000 The Comprehensive General Liability policy shall include blanket contractual liability coverage ar a contractual liability endorsement covering the liability assumed by the ENGINEER under this AGREEMENT, with limits not less than those specified herein. Certificates furnished hereunder shall reflect such coverage.
