The ENGINEER warrants that no person or selling agency has been employed or <br /> retained to solicit or secure this contract upon an agreement or understanding for a <br /> commission,percentage,brokerage,or contingent fee,excepting bonafide employees. <br /> For breach or violation of this warranty, the OWNER shall have the right to annul <br /> this AGREEMENT without liability or in its discretion to deduct from the contract <br /> price or consideration or otherwise recover,the full amount of such commission,per- <br /> centage, brokerage or contingent fee. <br /> g. The ENGINEER certifies that the services of anyone that has been debarred or <br /> suspended under federal Executive Order 12549 has not or will not be used for <br /> planning, design and construction. <br /> 3. Insurance- The ENGINEER shall procure and maintain, at its expense, insurance of the <br /> type and in the minimum amounts stated below: <br /> a. Worker's Compensation: <br /> Coverage A. Statutory Benefits <br /> Coverage B. Employers' Liability as follows: <br /> Bodily injury by accident $100,00 each accident <br /> Bodily injury by disease $500.00 policy limit <br /> Bodily injury by disease $100,000 each employee <br /> b. Commercial General Liability: <br /> Each Occurrence Limit $1,000,000 <br /> Personal Advertising Injury Limit $1,000,000 � <br /> Products/Completed Operation Aggregate Limit $2,000,000 <br /> General Aggregate Limit $2,000,000 <br /> c. Comprehensive Automobile Liability: <br /> Combined Single Limit, Each Accident $1,000,000 <br /> d. Architects & Engineers Professional Liability: <br /> Each Claim Limit $2,000,000 <br /> Aggregate Limit $2,000,000 <br /> e. Umbrella over above Items a., b. and c. $1,OOC�,000 <br /> The Comprehensive General Liability policy shall include blanket contractual liability coverage ar <br /> a contractual liability endorsement covering the liability assumed by the ENGINEER under this <br /> AGREEMENT, with limits not less than those specified herein.
