The Owner shall file an annexation petition with the City, in compliance with �� <br /> 65 ILCS 5/7-1-8, said petition to describe the Premises and to request that the same be I <br /> annexed to and included within the corporate limits of the City. ! <br /> 2. The City hereby waives any requirement otherwise applicable that Owner <br /> pays to the City any fee for filing the petition referred to in paragraph 1 hereof. I' <br /> 3. Upon receipt of said annexation petition, the City shall annex the territory , <br /> described therein to the City as provided by law. �I <br /> 4. That upon annexation, the City, by ordinance, shall classify and place the I�,, <br /> Premises in the R-1 Single Family Residence District, as per the provisions of City of ��, <br /> Decatur Ordinance No. 3512, as amended (the "Zoning Ordinance"). <br /> 5. (a) That upon annexation, Owner shall construct a 12" water main, with a 30" <br /> casing and all required fittings, valves and appurtenances, under Interstate 72 to the <br /> Premises. When completed, the Owner shall dedicate such main to the City, and the <br /> City shall accept said main if it meets all City standards and specifications. Upon <br /> acceptance, the City shall reimburse Owner not to exceed Forty Thousand Dollars <br /> ($40,000.00) for the construction of said water main. <br /> (b) The City shall approve all designs, plans and contracts related to said <br /> water main prior to the construction thereof, and Owner shall obtain all required permits <br /> for said construction, including, but not limited to, NPDES, EPA and IDOT permits. <br /> 6. That upon annexation, Owner shall dedicate to the City a permanent <br /> easement for public utility purposes, said easement to be a minimum of forty (40) feet <br /> in width and to extend from the north right of way line of West Ash Avenue northeast- <br /> erly along Interstate 72 to the termination point of the above-described water main, as <br />
