. <br /> effort where warranted. Attorney and third-party claims adjusters' billing shall be <br /> analyzed for consistency and compliance with customary practices. Contractor shall <br /> coordinate and expedite, where necessary, communication with any third-party adjusfers <br /> and attorneys. <br /> 3.5 Special Account Instructions: In performing its duties hereunder, Contractor shall use <br /> its best efforts to comply with the City's instructions, provided, however, that nothing <br /> contained in those instructions conflicts with any duty owed to any entity providing <br /> insurance converge to the City, or with any applicable laws, rules, or regulations <br /> pertaining to performance of services hereunder. <br /> 3.6 Reporting: The Contractor shall provide the City with monthly summary reports of <br /> activity and status of claims; including loss experience, total claims by type, amount of <br /> claims paid, and other information as required by the City. <br /> 3.7 Risk Control: The Contractor shall provide consulting services, as requested by the <br /> City, in the areas of risk assessment to minimize risks and on-site training designed to <br /> irnprove safety and reduce the number of liability claims. <br /> 3.8 Other Services: The <br /> Contractor shall rovide other <br /> p services which ma from time to <br /> Y <br />� time be required by the City to fulfill the intent of this AGREEMENT. <br /> 4. RIGHTS AND DUTIES OF THE CITY <br /> 4.1 Claims Reporting: The City shall promptly report to Contractor each Claim that the <br /> City desires Contractor to handle under this AGREEMENT. <br /> 4.2 Coverage Verification: For each Claim reported to Contractor, the City shall verify the <br /> types of insurance coverage applicable at the time of the loss or injury giving rise to the <br /> Claim, and shall notify Contractor of the same within seventy-two (72)hours after the <br /> Claim is submitted to the Contractor. <br /> 4.3 Required Information: As a condition to Contractor's performance of services <br /> hereunder, the City shall provide to Contractor copies of all applicable Self-Insurance <br /> Law/Filings, and such identifying and contract information regarding the City as <br /> Contractor may require in order to provide services under this AGREEMENT. Such <br /> identifying and contract information shall be updated by the City as necessary. <br /> 4.4 Cooperation of the City: The City shall assist Contractor in the investigation; defense, <br /> and settlement of any Claim upon request by Contractor, and shall take all steps <br /> reasonably necessary to allow Contractor to perform its duties hereunder, including <br /> providing Contractor with any requested documents and witnesses necessary to <br /> invesrigate, defend, and settle any Claim. <br /> -4 - <br />
