(a) After securing all necessary <br /> permits from the Illinois Environmental Protection Agency, the Owner shall be permitted <br /> to connect to existing City water mains as directed by the City's Director of Engineering <br /> and Infrastructure. <br /> (b) The Owner shall use and exercise all reasonable means and <br /> facilities to install water transmission lines (the Water Lines) within the Subject Property <br /> sufficient to carry an adequate supply of water to service the Development. Said lines <br /> shall be constructed in accordance with City standards and all applicable City codes <br /> and ordinances. Each property owner within the Development must install an exterior, <br /> remote water meter. <br /> (c) The City shall reimburse the Owner for the costs Owner incurs to <br /> extend the City's water main to a point fifty feet inside the Subject Property within the <br /> utility easement, as depicted on the preliminary plat. Reimbursement by the City to <br /> Owner shall be paid pursuant to the reimbursement section herein. <br /> 7. SEWERS, DRAINAGE AND TREATMENT FACILITIES. (a) The Owner <br /> shall be responsible for securing all necessary permits from the Illinois Environmental <br /> Protection Agency and the Decatur Sanitary District to connect to the existing sanitary <br /> sewer owned by said District. <br /> (b) The Owner shall use and exercise all reasonable means and <br /> facilities to install sanitary sewer trunk lines within the Subject Property sufficient to <br /> serve the Development. Said lines shall be constructed according to plans approved by <br /> the City's Director of Engineering and Infrastructure. <br /> (c) The owner shall cause the Development Parcel to be annexed to <br /> the Decatur Sanitary District prior to making any sewer connections and shall pay any <br /> necessary annexation fees. <br /> (d) The City shall reimburse Owner for eligible reimbursement <br /> expenses that, when added to eligible reimbursement expenses in paragraph 6{c} do <br /> not exceed Ninety-Five Thousand Dollars ($95,000.00) incurred to extend the sanitary <br /> sewer trunk line from the Decatur Sanitary District's sewer main to the Subject Property <br /> within the utility easement, as depicted on the preliminary plat. Eligible reimbursement <br /> expenses shall include the costs of engineering design fees, tunnel-boring, installation <br /> of pump station facilities and sanitary sewer force mains providing service thereto. <br /> Reimbursement by the City to the Owner shall be paid pursuant to the reimbursement <br /> section herein. <br /> 8. DEDICATION OF IMPROVEMENTS. (a) The Owner hereby dedicates to <br /> the City those sanitary sewers and water lines constructed in the utility easements <br /> shown on the preliminary plat.
