The remaining mileage in each original tire and retread shall be determined by multiplying the <br /> number of 32nds of an inch of available rubber remaining on each tire by the applicable f�ed <br /> cost per 32nd shown on the following table: <br /> Fixed Cost Per 32nd <br /> TIRE SIZE ORIGINAL RETREAD <br /> COST/32nd COST/32nd <br /> 9R22.5 $12.73 $9.00 <br /> 12R22.5 $12.82 $9.00 <br /> 275/70R22.5 $12.35 $9.00 <br /> Example: Original 12R22.5 tire is partly worn, with 10/32nds remaining. <br /> Cost = 10/32nds remaining X $12.82 per 32nd = $128.20. <br /> When a tire is not available for inspection to apply the above calculation(s),whether lost, stolen <br /> or otherwise missing, or destroyed by fire, or involved in an accident, reimbursement shall not be <br /> in excess of fifty percent (50%) of the current value of a similar tire, unless the CIT'Y or the <br /> MANUFACTLJRER can provide an auditable accounting of the tire's accurate mileage just prior <br /> to the loss. <br /> The foregoing notwithstanding, the CITY may upon thirty(30) days written notice via certified <br /> mail prior to the expiration date of this Agreement elect to continue using("run out") all the tires <br /> in the CITY's possession at the rates in effect during the su� (6)months prior to termination until <br /> permanently removed from service, but in no event shall such period exceed thirty-six (36) <br /> months after the normal expiration date of this Agreement. During said run out period, the City <br /> shall to the extent practicable, continuously use such tires on its highest mileage runs until they <br /> are rendered permanently unfit for service. During said run out period, all terms and conditions <br /> of this Agreement shall continue in effect, provided, however, that the MANUFACTURER shall <br /> not be obligated to fumish any service to the CITY or to furnish replacement tires for those tires <br /> removed from service. At the end of said run out period, the CITY shall pay for the remaining <br /> tires at the price and in the manner set forth above, and shall acquire such tires as is, without <br /> warranty as to the condition or fitness for continued use of such tire. <br /> Decatur Public Transit System 14 Tire Lease Agreement <br />
