TIRE LEASE AGREEMENT <br /> This Agreement is made and entered into by and between the CTI'Y OF DECATtJR, ILLINOIS, <br /> a municipal corporation in the state of Illinois, hereinafter referred to as the "CTTY", and <br /> BRIDGESTONE/FIRESTONE NORTH AMERICAN TIRE, LLC, a Delaware Limited <br /> Liability Company with its principal offices in Nashville, Tennessee, hereinafter referred to as <br /> the "MANUFACTIJRER". Any proposed change in this Agreement shall be submitted to the <br /> City of Decatur for its prior approval. <br /> 1. TERM OF AGREEMENT <br /> This Agreement shall become and be effective as of July 1, 2004, and shall continue in effect <br /> through June 30, 2009. , <br /> 2. FINANCIAL ASSISTANCE <br /> This Agreement is subject to the funding and approval of the US Department of Transportation, <br /> Federal Transit Administration (FTA) and the Illinois Department of Transportation(IDOT), and <br /> is subject to financial assistance contracts between the City of Decatur and the Illinois Department <br /> of Transportation and the US Department of Transportation, Federal Transit Administration. <br /> 3. COMMUNICATIONS <br /> For purposes of this agreement, all notices and other communications shall be addressed to the <br /> respective parties as follows: <br /> CITY MANUFACTURER <br />� The City of Decatur, Illinois Bridgestone/Firestone <br /> #1 Gary K. Anderson Plaza North American Tire, LLC <br /> Decatur, IL 62523-1196 Mileage Sales Division <br /> 1200 Firestone Parkway <br /> Akron, Ohio 44317-0001 <br /> The persons to whom notices shall be addressed are: <br /> • CITY: Paul McChancy, Mass Transit Administrator <br /> • MANUFACTURER: Janet M. Bragg, Contract Administrator <br /> No oral or electronic communication shall be considered to be official until and unless it is <br /> confirmed in writing. <br /> 4. SCOPE OF SERVICES <br /> The CITY agrees to lease from the MANUFACT'LTRER, and the MANUFACTURER agrees to <br /> lease to the CITY such number of tires of the sizes and types as may be sufficient and required to <br /> keep all of the CITY's transit coaches and trolley replica coaches fully equipped and to provide <br /> an adequate reserve supply; provided, however, that the CITY shall have the right, upon thirty <br /> (30) days written notice to the MANUFACTURER, to equip up to five percent(5%) of its <br /> coaches with tires obtained from other suppliers, for testing purposes. <br /> Decatur Public Transit System 1 Tire Lease Agreement <br />
