, ' . � distribution system to the Shepherds Hill subdivision, located south of the intersection of South Franklin Street and County Highway 30, in South Wheatland Township. If construction of a City water main to that location has not been completed by October 1, 2005, the Town may, at the Town's discretion, extend the Town's County Highway 30 water main west to provide water to the Shepherds Hill subdivision and areas South of C.H. 30. (b) Within that area described on Exhibit B hereto, the following shall apply: (i) The City shall supply water service for all purposes to those premises with frontage on Rt. 121 and lying north of the McDonald's Restaurant existing on the effective date hereof, including service to such McDonald's premises, and to Lot 2 of f�ldi addiiion as per Plat recoi-Ged in Book 1332 r��e 3SQ of,he reccr�s in the Recorder's Office of Macon County, Illinois; the Town shall supply water service for all purposes to those premises with such frontage lying south of said McDonald's premises, but not including said Lot 2 of Aldi Addition. (ii) The City shall supply water service to all commercial premises that are existing at the time this Agreement is executed in said area not covered by the provisions of subparagraph (i), and the Town shall provide water service to all residential premises in said area not covered by the provisions of subparagraph (i), including residential premises that later become commercial premises during the term of this Agreement. (iii) The City shall continue to supply water to the following addresses that are to the west of, and adjacent to, Exhibit B: 4012 Maynor, 4013 Maynor, 4052 Maynor, 1762 Sandy Place, 1821 Sandy Place, 1824 Sandy Place and 1839 Sandy Place. Nothing in subparagraph (b) shall be construed to affect water services in existence on the effective date of this Agreement. 3. That during the term of this Agreement the Town may not offer and maintain water service to any users on the City's side of the boundary line described in Exhibit A , except fior those services in existence on the effective date of this Agreement. 4. That any extension or modification of the City's and Town's water systems shall be constructed in compliance with the established standards used by the Illinois Environmental Protection Agency for similar construction. 5. That no connection to the Town system for a water service or otherwise shall be made except by a plumber licensed by the State of Illinois or by an employee of the Town. 2
