AMENDMENT TO EMPLOYMENT AGREEMENT This AMENDMENT TO EMPLOYMENT AGREEMENT is entered into this 19th day of April, 2004, by and between the city of Decatur, Illinois ("City"), a municipal corporation, and Steve Garman("Employee"). , WHEREAS, the parties hereto previously entered into and executed as EMPLOYMENT AGREEMENT, dated September 24, 1999, and subsequently amended November 15, 1999, February 5, 2001, January 21, 2003, and June 30, 2003, which AGREEMENT the parties now wish to amend as set forth herein; and, WHEREAS, said EMPLOYMENT AGREEMENT shall remain fully enforceable and effective, as written and previously amended, except as to matters expressly amended or modified as set forth herein. NOW, THEREFORE, for and in consideration of the mutual covenants, warranties and agreements contained herein, the parties hereto do hereby covenant and agree as follows: 1. The EMPLOYMENT AGREEMENT previously executed and amended as aforesaid ("AGREEMENT") shall remain in full force and effect, as written and amended, except as ma.y be modified or amended as expressly set forth herein. 2. Section 11 of the AGREEMENT shall be amended and modified at the first paragraph thereof such that said first paragraph, as so amended and modified, shall provide as follows: Employee shall receive an automobile allowance of Five Hundred Dollars ($500.00) per month. This allowance shall compensate the EMPLOYEE for the use of his personal automobile in the course of CITY business and shall be paid in lieu of mileage or any other method of reimbursement. Section 3. The amendment to Section 11 of the AGREEMENT, as set out in paragraph 2 hereof, shall be effective on and after May 1, 2004. DATED this 19th day of April, 2004.
