c. If the Contract is terminated pursuant to this Paragraph 25, the Contractor shall be paid only for that portion of the Work completed in a satisfactory manner, as determined by the Owner and Sponsor. 26. Termination of the Contract by the S onsor. The Owner and the Contractor agree that, upon five (5)business days' written notice, the Project may be suspended or terminated in whole or in part by the Sponsor for the Owner's violation of this contract or of the Agreements between the Owner and the Sponsor. The Contractor further agrees - that the Contractor shall receive payment only for the Work performed by the Contractor through the date of termination or suspension if the Project is suspended or terminated pursuant to this Paragraph 26. 27. Sponsor's Right to Susnend Work and/or Remove Contractor from Job Site. a. The Owner and the Contractor agree that the Sponsor retains the right to stop work at any time during the project for violation of regulations,rules or guidelines regarding worker safety or the safe removal or mitigation of Lead-Based Paint or its Hazards, as�romulgated by(i) OSHA; (ii) the U.S. or Illinois Environmental Protection agencies; (iii)the U.S. Department of Housing and Urban Development; (iv)the Illinois Department of Public Health; (v) the City of Decatur's insurer for pollution liability; or(vi) any other state or federal agency that has oversight or regulatory authority over Lead-Based Paint Hazard Mitigation or Abatement. b. The Sponsor's Right to Stop Work shall not require prior notice from the Sponsor to the Owner, and may be immediate, instant and without delay. c. Sponsor also retains the right, in cases of serious or repeated violation that endanger the safety of workers, the envirorunent, surrounding properties and/or persons in the vicinity of the worksite,to Stop Work immediately and Remove the Contractor from the Job Site. In the event the Contractor is removed from the Job Site, the Contractor shall secure the property, including protecting the property and mitigating potential risks that could result in damage or loss due to theft, burglary, vandalism, fire,water, wind, or any other Act of God, and turn all keys over to the Sponsor prior to leaving the Job Site. d. In instances where the Sponsor stops work and/or removes the Contractor from the Job Site, the Sponsor shall orally cite to the Contractor the reasons for its action. The Sponsor shall serve written notice citing the reasons personally or by certified mail, return receipt requested,within three (3)business days from the date of the Sponsor's act, unless the Contractor named in this Agreement has resumed work under this contract.
