Provision Chan�e <br /> 7.2.4 The following language is hereby inserted in the first sentence of Paragraph 7.2.4 following <br /> "...vacations and pensions..."and before "...provided such costs are based on wages..." <br /> "but not merit bonuses," <br /> 7.5.5 The following language is hereby added to the end of the fust sentence of Paragraph 7.5.5: <br /> "with the exception of normal commuting(i.e.,regular daily travel over the distance to <br /> and from the Project site and a residence) expense by Contractor, any Subcontractor or <br /> supplier personnel to and from the site and otherwise only with the Owner's prior <br /> approval." <br /> 7.6.8 Paragraph 7.6.8 is hereby deleted in its entirety. <br /> 7.7.2 The following language is hereby added to the end of the first sentence of Paragraph 7.7.2: <br /> " , provided such emergency did not result from the fault or negligence of the <br /> Contractor,any Subcontractor or supplier." <br /> 7.7.3 This Paragraph is hereby deleted and replaced with the following: ,I <br /> "7.73 Costs of repairing or correcting damaged or nonconforming Work executed by � <br /> the Contractor, Subcontractors or suppliers, provided that such damaged or <br /> nonconforming Work was not caused by negligence or failure to fulfill a specific <br /> responsibility of the Contractor, Subcontractors or suppliers and only to the extent that <br /> the cost of repair or correction is not recoverable by the Contractor from insurance, <br /> sureties, Subcontractors or suppliers provided any absence of collectible insurance is <br /> not due to the Contractors breach on a contract for insurance." <br /> 7.8 There is hereby added the following provision after Secrion 7.73: <br /> "7.8 T'he Contractor shall keep accurate records of account of the Cost of the Work,and <br /> shall, upon demand, make such records, invoices, receipts, subcontracts and other <br /> informarion pertaining to the Work available for inspection by Owner, DHA and HUD. <br /> With its final applicarion for payment, the Contractor shall furnish to Owner a <br /> completed Certificate of the Cost of the Work, accornpanied and supported by an <br /> independent certified public accountant's certificate as to actual cost, in form acceptable <br /> to HLJD and Owner. The Contractor shall include in all subcontracts, equipment leases <br /> and purchase orders a provision requiring the subcontractor, equipment lessor or <br /> supplier to certify its costs incurred in connection with the Work,in the event that HUD <br /> determines there is an identity of interest between either Owner or Contractor and any <br /> such subcontractor,equipment lessor or supplier." <br /> 8.1.8 Following Paragraph 8.1.8,the following are hereby inserted: <br /> "8.1.9 Any cost which is reimbursable under any insurance maintained by Contractor <br /> or any Subcontractor or Sub-subcontractor or which would be reimbursable under <br /> insurance required to be maintained by Contractor or any Subcontractor or Sub- <br /> subcontractor under the Contract Documents. <br /> 8.1.10 Costs atkributable to perfornung or fiunishing General Job Conditions. <br /> 3 <br /> Doc#:CHI01 (239130-00107)50130735v3:08/12/2003/Time:10:48 <br />
