and inserting the following in substitution of such subparagraphs as follows: <br /> "(i) asbestos abatement from the Sunnyside School and Mound School <br /> buildings;" <br /> and <br /> "(u) demolition of the Sunnyside School and Mound School buildings;" <br /> 2. Article 3 of the Development Agreement is further amended by <br /> � deleting subparagraph(a)(v) which currently provides: <br /> "(v) construction of the shared monument sign on the Developer Tract as <br /> described in the Target Purchase Agreement;" <br /> and inserting the following in substitution of such subparagraph as follows: <br /> "(v) construction of the shared monument sign on the Developer Tract as <br /> descnbed in the Target Purchase Agreement if not completed by <br /> Target as provided in the Operation and Easement Agreement and Site <br /> Development Agreement;". <br /> 3. Article 6 of the Development Agreement is amended by increasing the <br /> amount in subsection B. from$1,200,000.00 to $1,500,000.00. <br /> 4. As modified by this Amendment, the Development Agreement is <br /> ratified and remains in full force and effect. <br /> 2 <br />
