� . , <br /> INFRASTRUCTURE FUNDING AGREEMENT <br /> THIS INFRASTRUCTURE DIN AGREEMENT (the "Agreement") is made <br /> and entered into as of the�day of � 2003, by and between the DECATUR <br /> HOUSING AUTHORITY ("Authority")t CITY OF DECATUR ("City"), and EAST <br /> LAKE/DECATUR, LLC ("Contractor"), an Illinois limited liability company. Capitalized <br /> and undefined terms used in this Agreement shall have the meaning given them in the <br /> Development Agreement (hereinafter defined). <br /> PREAMBLE <br /> A. The Authority has previously received from the U.S. Department of Housing and Urban <br /> Development ("HUD") a grant in the amount of$34,863,615 for the revitalization of the <br /> Longview Place public housing development (`�HOPE VI Grant"). In order to <br /> accomplish the revitalization, the Authority and City have entered into a Development <br /> Agreement ("Development Agreement") with an affiliate of Contractor("Developer") <br /> dated December 17, 2002. <br /> B. Pursuant to the Development Agreement, the Authority, the City, and the Developer <br /> intend to make improvements to certain real property in the City of Decatur, Illinois and <br /> more particularly described on E�ibit A attached hereto and made a part hereof by <br /> reference(the��Redevelopment Site"). <br /> C. Authority will lease a portion of the Redevelopment Site to Developer for the <br /> construction of a 206 unit multifamily rental project to be known as Wabash Crossing <br /> Phase I (��Project") and transfer fee simple ownership of a portion of the Redevelopment <br /> Site for the construction of forty three(43) single family homes. <br /> D. City is the owner of certain real property within the Redevelopment Site upon which, in <br /> accordance with the terms of the Development Agreement, the Developer will construct <br /> or cause to be constructed the Phase I Infrastructure Component and a portion of the <br /> Phase II Infrastructure Component (hereinafter defined) identified in the Revitalization <br /> Plan which the parties have agreed to undertake at this time and which will serve the <br /> Redevelopment Site and the Project (the��City Parcel") (collectively, the Phase I <br /> Infrastructure Component and Phase II Infrastructure Component are referred to herein as <br /> the "Infrastructure Improvements"). <br /> E. In order to ensure that construction of the Project is commenced in a timely manner and <br /> to prepare the infrastructure to service the Project, the Developer has requested that the <br /> Authority permit the Contractor to commence the Infrastructure Improvements as soon as <br /> feasible. <br /> F. Pursuant to the Development Agreement, the Authority has agreed to contribute <br /> $4,691,396 in HOPE VI Grant funds and capital funds toward the Phase I Infrastructure <br /> Component and the City has agreed to contribute $2,300,000 toward the Public <br /> Infrastructure Improvements of the Phase I Infrastructure Component.
