AGREEMENT <br /> This Agreement rnade this 16th �y of April, 2003, by and between the City of Deca- <br /> tur, Illinois ("City"), a municipal corporation, and the Decatur Park District, a unit of local gov- <br /> emment. <br /> Whereas, the City owns and opera.tes an 800 MHz Radio System (the "System") for use <br /> in dispatching law enforcement and fire and rescue services by various public agencies; and, <br /> Whereas, the District wishes to have access to the System such that those radios used by <br /> personnel of the Decatur Pazk District can communicate with the System and with other users of <br /> the System; and, <br /> Whereas, the City is willing to grant the Decatur Pazk District such access, on the terms <br /> and conditions set out herein. <br /> NOW, THEREFORE, for and in consideration of the provisions hereof, the City and the <br /> District agree as follows: <br /> l. The System is hereby defined as that 800 MHz radio system owned and operated by <br /> the City,the dispatch center for which is located in the Law Enforcement Center, 333 S. Franklin <br /> Street, and includes but is not limited to all towers, transmitters, receivers, cantrollers, micro- <br /> wave transmitters/receivers, computers, soflware and firmware, electronic circuit boards and all <br /> other components located in any part of the System, as well as the power supply thereto and the <br /> physical facilities supporting or housing the same. The System does not include portable or mo- <br /> bile radio transmitters/receivers owned by any entity other than the City. <br /> 2. Subject to compliance with a11 of the terms and conditions of this Agreement, the City <br /> hereby grants to the Decatur Pazk District access to the System for those radios used by the De- <br /> catur Park District. The District sha11 not allow the use of said radios by any other individual or <br /> entity that is not directly employed by the District, except with the written approval of the City. <br /> 3. For access to the System as herein provided, the District sha11 pay to the City a <br /> monthly fee of Seventeen Dollars ($17.00) per radio which has been programmed to be used on <br /> the System regardless of the level of use or activity of that radio. The monthly fee sha11 be paid <br /> within ten(10)days after the first day of each month for which the fee is in effect. The monthly <br /> fee sha11 be in effect as of the earliest date any District ra.dio was programmed to work within the <br /> System. <br /> 4. The Decatur Pa.rk District shall be limited to no more than one hundred (100) radios <br /> to be programmed for utilization on the System. The City reserves the right to increase said <br /> monthly per radio charge, with 30 day written notice, if the District exceeds this limita.tion. Ad- <br /> ditionally, the City reserves the right to increase the monthly per radio fee, based on District us- <br /> age as a percentage of total System users, as a result of System upgrades or the installation of <br /> new technology to maintain the System integrity. <br />
