a � <br /> EXCLUSIVE DISPOSAL AGREEMENT <br /> This Agreement made this 4th day of March 2003, by and between Evans Recycling, Inc. <br /> ("Evans") its successors, agents and assigns AND the City of Decatur("City"). <br /> WHEREAS, it is agreed and understood by the parties that Evans operates a composting <br /> facility known as the Decatur/Macon County Composting Facility. <br /> WHEREAS, City collects and transports recyclable materials suitable for composting. <br /> WHEREAS, the parties agree that there exists certain economies of scale in the <br /> collecting, transporting, depositing and composting of certain recyclable material. <br /> WHEREAS, the parties agree that among the purposes of this agreement is to facilitate <br /> .accessibility of composting materials for recycling and to reasonably minimize the costs of <br /> collecting, transporting, depositing and composting of certain recyclable material. <br /> WHEREAS, this agreement reasonably protects lawful business interests of each of the , <br /> parties and the parties believe this agreement to be reasonable in time, place and terms and <br /> further insures a benefit to the community by providing a reasonable outlet for recyclable <br /> materials at a fair and reasonable price. <br /> For and in consideration of the provisions set forth herein, Evans and City agree as <br /> follows: <br />
