At or before Settlement,Seller shall give Buyer credit for general real estate taxes for <br /> the year 2002,payable in 2003 and pro-rata taxes for 2003 to time of settlement. Seller shall further <br /> pay or give Buyer credit for all special assessments now a lien against the Premises. Credit to Buyer <br /> for general real estate taxes not yet payable shall be computed to date of settlement upon the basis <br /> of the most current tax information available at the time of Settlement. <br /> 6. Buyer shall be entitled to possession of Premises at Settlement. <br /> 7. The Premises is a vacant commercial building which Buyer purchases"as is"without ' <br /> warranty. , <br /> 8. Buyer and Seller shall furnish all information legally required for financing or transfer ', <br /> of title. ' <br /> 9. Seller warrants that to the best of its knowledge it is not aware of an notices, suits I�, <br /> Y � <br /> or judgments relating to violations at the Premises of zoning, fire, air pollution or health laws and <br /> regulations. <br /> 10. Any notice given or required in this Agreement shall be given in writing either <br /> personally or by certified mail,postage prepaid with return receipt requested,and addressed to Seller <br /> c/o Ronald Reck, Millikin University, 1184 W. Main Street, Decatur, Illinois 62522, or to Buyer <br /> c/o John Couter,City of Decatur,#1 Gary Anderson Plaza,Decatur,Illinois 62523. All such notices <br /> shall be deemed to have been given on the date of personal service or on the date postmarked. Such <br /> notice is sufficient if served upon or addressed to any one Seller or any one Buyer. <br /> 11. This Agreement shall be binding upon the heirs,executors,administrators,successors <br /> and assigns of Seller and Buyer(which terms include the plural when appropriate). Where "now" <br /> or"this date"is used,the latest date of signing is intended.
