These most recent changes include: (a) the modification to Mr. Garman's salary(which "new" salary figure then is used elsewhere in his agreement); (b)the modification to the provision of paid vacation days to Mr. Garman;and(c)the change in calculating Mr. Garman's mileage reimbursement for personal use of the City-owned automobile provided to him by the City. Paragraphs 5-7 of the Second Amendment to Employment Agreement includes some provisions to identify that Mr. Garman's employment relationship with the City remains subject to a written agreement, to which the parties have freely and knowingly assented. In the future,the City may wish to "consolidate" the terms of the 1999 agreement,the 1999 amendments and the Second Amendment to Employment Agreement for purposes of precision and clarity. We understand that the City intends to make available copies of the Second Amendment to Employment Agreement to members of the City Council. Additionally,we are providing a copy of the present correspondence, and the Second Amendment to Employment Agreement, to Mr. Garman. Should the City approve the Second Amendment to Employment Agreement,we ask that the City and Mr. Garman execute two (2) originals thereof(which are enclosed), and that the City deliver a copy of the executed Second Amendment to Employment Agreement to us for our files. In addition, we are enclosing numerous copies of the Second Amendment to Employment Agreement for provision to the City Council. Thank you for your attention to these matters.
