ECONOMIC AND URBAN DEVELOPMENT MEMORANDUM
No. 02-121
December 9, 2002
TO: Mayor Terry M. Howley and City Council Members
FROM: Steve Garman, City Manager
A. J. Krieger, Assistant City Manager
Dane C. Bragg, Economic Develo ent oordinato
SUBJECT: Grant of Easement - 134 East Main Street
SUMMARY RECOMMENDATION: Staff recommends approval of the attached resolution
authorizing a 336 square foot easement to be granted to Real Estate Investors of Decatur, LLC to
permit the placement of a fire escape structure and HVAC equipment on property owned by the
City.
BACKGROUND: The developer proposes to construct a fire escape ladder and platform
attached to the rear of the building. The platform would also house HVAC equipment used for
upper floors of the building. The area in which the fire escape would be located is a portion of a
lot that connects to the Merchant Street alley and is owned by the City of Decatur. The lot
provides rear access to various buildings in the downtown block. The proposed structure would
not interfere with, or prevent, access to any of the buildings that front the property.
Emergency access would be maintained to buildings along the alley and the City would reserve
the right to use the property for the construction on infrastructure and/or public safety
improvements. City staff has recommended to the petitioner a fee of$1.00 per square foot of
easement area, or $336.00, as appropriate compensation for the use of the easement. The
developer would be required to obtain building permits for construction within the easement.
The proposed fire escape is critical to the developer's ability to reuse the building within existing
building code requirements. There is no foreseeable negative impact of granting the easement on
the subject property.
POTENTIAL OBJECTION: No objections have been received.
INPUT FROM OTHER SOURCES: The easement documents have been reviewed by and
found satisfactory to both the Department of Engineering and Infrastructure and the Legal
Department.
