Bragg, Economic Develop en oordinator�( <br /> SUBJECT: Grant of Easement - 400 Block North Short Street <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the attached resolution <br /> authorizing a 91 square foot easement to be granted to MedPointe Health Systems, Inc. for the <br /> placement of equipment within the right-of-way of the 400 Block of North Short Street. <br /> BACKGROUND: MedPointe Health Systems, Inc. (Wallace Pharmaceuticals) has been <br /> actively updating and expanding their Decatur facility. As a part of this expansion project, the <br /> phannaceutical manufacturer has been acquiring property in order to expand, as well as <br /> completing improvements to the existing facility. The current facility is largely land-locked by <br /> other industrial uses to the south and east and is constrained by Eldorado Street on the north. <br /> MedPointe is upgrading its ventilation control systems in response to changing requirements of <br /> the Food and Drug Administration. A specific ventilation unit is required that can be placed only <br /> adjacent to the east end of the building due to the interior configuration of production facilities. <br /> The existing building is located immediately adjacent to the Short Street right-of-way on the east <br /> side and there is no space available to MedPointe to construct the ventilation system on private <br /> property. <br /> With the obvious space availability situation, MedPointe has requested that the City grant a <br /> permanent easement to place the equipment in the right-of-way. The proposed equipment would <br /> be fenced and the City would be held harmless from any claims or injury resulting from <br /> MedPointe's use of the easement. Emergency access would be maintained through the 24 foot <br /> lane width upon completion of curbing around the proposed equipment. City staff has <br /> recommended to the petitioner a fee of $1.00 per square foot of easement area, or $91.00, as <br /> appropriate compensation for the use of the easement. MedPointe has the intention of requesting <br /> the vacation of the Short Street right-of-way south of Eldorado Street upon completion of <br /> property acquisition on the west side of the street. The easement would also be vacated if the <br /> petitioner were to successfully vacate the subject right-of-way. <br />
