GTY OF DECATUR <br /> (MACON COUNTY) <br /> FAP 323 & FAP 741 (US 36 & IL 105) <br /> Section 13(Z,Z-1)TS-I & 12R-TS <br /> Macon County <br /> Job No. C-95-050-96 <br /> Agreement No. JN 502 015 <br /> Contract No. 90835 <br /> AGREEMENT <br /> This agreement entered into this 7*h day of Na✓ , A.D., 20 ca` , by and between <br /> the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION <br /> hereinafter called the STATE, and the City of Decatur, of the State of Illinois, hereinafter called <br /> the CITY. <br /> WITNESSETH: <br /> WHEREAS, the STATE, in order to facilitate the free flow of traffic and insure safety to �� <br /> the motoring public, is desirous of improving FAP 323 (US 36) from West Eldorado Street to <br /> Martin Luther King Jr. Drive and FAP 741 (IL 105) at Brush College Road in Decatur, State <br /> Section 13(Z,Z-1)TS-I & 12R-TS by modernizing traffic signals and interconnect at various US <br /> Route 36 intersections between West Eldorado Street and Martin Luther King, Jr. Drive; at IL <br /> 105 (22�d Street) from US 36 to Eldorado Street; as well as on US 36 from 23`d Street to Wood <br /> Street, and by performing all other work necessary to complete the improvement in accordance <br /> with the approved plans and specifications; and <br /> WHEREAS, the CITY, is desirous of said improvement in that same will be of immediate <br /> benefit to the CITY, residents and permanent in nature; <br /> NOW, THEREFORE, in consideration of the mutual covenants contained herein, the <br /> parties hereto agree as follows: <br /> 1. The STATE agrees to make the surveys, obtain all necessary rights-of-way, prepare <br /> plans and specifications, receive bids and award the contract, furnish engineering <br /> inspection during construction and cause the improvement to be built in accordance with <br /> the plans, specifications and contract. <br /> 2. The STATE agrees to pay for all right-of-way, construction and engineering costs, <br /> subject to reimbursement by the CITY, as hereinafter stipulated. <br />
