5. The CITY shall exercise its franchise rights to cause private utilities to be relocated, if <br /> required, at no expense to the STATE. <br /> 6. The CITY agrees to cause its utilities installed on right-of-way after said right-of-way was <br /> acquired by the STATE or installed within the limits of a roadway after the said <br /> roadway's jurisdiction was assumed by the STATE, to be relocated and/or adjusted, if <br /> required, at no expense to the STATE. <br /> 7. Upon acceptance by the STATE of the new traffic signal interconnect installations, the 'i <br /> financial responsibility for maintenance and electrical energy for the operation of the ' <br /> traffic signal interconnect systems shall be proportioned as follows: I <br /> Intersection Maintenance Elect. Enerqv <br /> US 36 Interconnect from West Eldorado STATE Share 64% 64% <br /> to Martin Luther King, Jr. Dr. CITY Share 36% 36% <br /> US 36 Interconnect from East Eldorado STATE Share 68% 68% <br /> (FAP 741)to Wood St. and IL 105 (22 <br /> Street) Interconnect from Eldorado to CITY Share 32% 32% <br /> US 36 <br /> It is mutually agreed that the actual traffic signal maintenance will be performed by the <br /> CITY, either with its own forces or through an ongoing contractual agreement. <br /> Upon acceptance by the STATE of the new traffic signal interconnect installations <br /> included herein, the responsibility for maintenance and energy outlined above shall <br /> become a part of the Master Agreement executed by the State and the CITY on <br /> July 6, 2001. <br /> 8. Upon acceptance by the STATE of the work proposed herein on existing signals, the <br /> responsibility for maintenance and energy shall continue to be as outlined in the <br /> aforementioned Master Agreement. <br /> 9. The CITY agrees to provide written approval of that portion of the plans and <br /> specifications relative to the CITY financial and maintenance obligations described <br /> herein, prior to the STATE's advertising for the aforedescribed proposed improvement. <br /> 10. Obligations of the STATE and CITY will cease immediately without penalty or further <br /> payment being required if, in any fiscal year, the Illinois General Assembly or Federal <br /> funding source fails to appropriate or otherwise make available funds for this contract. <br />' 11. This AGREEMENT and the covenants contained herein shall be null and void in the <br /> event the contract covering the construction work contemplated herein is not awarded <br /> within the three years subsequent to execution of the agreement. <br /> -3- <br />
