Penalties; liability; fund. <br /> 17 (a) Every person who, while engaging in excavation or <br /> 18 demolition, wilfully fails to comply with the Act by failing <br /> 19 to provide the notice to the owners or operators of the <br /> 20 underground facilities or CATS facility near the excavation <br /> 21 or demolition area through the State-Wide One-Call Notice <br /> 22 System as required by Section 4 of this Act aa�-�a�ages-asy <br /> 23 HA�E���9LiA�-H�3}3�Y-€323�3$323-6�-EA�6-€d@3�3$3@B7 shall be <br /> 24 subject to a penalty €3ae of � to $5,000 se-�e�e-E�as-$�96 <br /> 25 for each separate offense and shall be liable for the damage <br /> 26 caused to the owners or operators of the facility. <br /> 27 (b) Every person who, while engaging in excavation or <br /> 28 demolition, ax� has provided the notice to the owners or <br /> 29 operators of the underground utility facilities or CATS <br /> 30 facilities in and near the excavation or demolition area <br /> 31 through the State-Wide One-Call Notice System as required by <br /> 32 Section 4 of this Act� but otherwise wilfully fails to comply <br /> 33 with this Act as�-�a�a�es-a�y-�x�e�g�exA�-xEi�iEy--€ae3�3E3es <br />
