Aa opcn-cn�dod regulated invest�ieat company under SectiOri 851 of the <br /> Code is not a Commingled Fund. <br /> "Control" means the passessian, directly or indiree�ly throu�h othvrs, of aithcr of the <br /> fol lowing discrctionary and non-ministerial rights or gowers ovcr another entity: <br /> (a) t� approve and to remove without cause a contmlling portion of the <br /> goveming body of a Cantrolled�ntity�,or <br /> (b) to requirc the usc of i�nds or asscts of a Contivlltd�ntity for any ptupose• <br /> "Controlled Group"means a group of entities directly or indirectly subject to Control by <br /> the sama cntity or group of entitics,including the entity that has Control of the other entities. <br /> "Existing Loan" meanc the eliglble capltal improvements to ch� Re�ipicnt's water ar <br /> financed with the Loan as described in the Loan Agrecmcztt. <br /> "Externa! Commingled Fund" means a Comminglcd Fut�d in which the Issuet and all <br /> membtrs of the same Controlled Group as the Issutr own, in thc nggrcgate, not more than ten <br /> perccnt of the beneficial intcrests. <br /> '7EPA Loans" means any and ail loans from the Agency or its assigns to thc Recipient <br /> for cican vvater or safe drinking water purposcs. <br /> B-1 <br />
