E., Director of Engineering & Infrastructur�� SUBJECT: Heritage Behavior Health Center Sewer Extension Agreement SUMMARY RECOMMENDATION: It is recommended by City staff that the City Council approve the attached resolution approving an Agreement between the Heritage Behavior Health Center and the City for the cost sharing of a sewer extension in the area of North Charles Street and Running Reds Drive and authorizing the Mayor to sign said agreement. BACKGROUND: The Heritage Behavior Health Center received City Council approval for a living center at the southwest corner of the intersection of North Charles Street and Running Reds Drive. This property is not presently adjacent to a sanitary sewer main and a new sewer must be extended for this property to have service. The City Council, in its approval of the project, indicated a willingness to participate with Heritage for the extension of the sewer in consideration of being able to provide service to the Charles Street area. It was noted that this would enable the City to extend service to a non-sewered area, particularly the properties on the east side of Charles Street. City staff and Blank, Wesselink, Cook & Associates (BWC), engineers for Heritage, have reviewed the extension of a sewer to serve the new Heritage facility and the properties along Charles Street. It was decided that the preferred route is for the new sewer to extend east from existing 12-inch sewer that is approximately 800 feet west of the Heritage site. The new sewer would run along the south boundary of Stephen Decatur Middle School, the south side of Running Reds Drive and then turn south on Charles Street (refer to attached drawing). The Engineering Division has reviewed and tentatively approved the design of the new sewer prepared by BWC. City staff and BWC, representing Heritage, discussed options for the cost sharing of the new ' sewer between the City and Heritage. The basic options included cost sharing based on a !, percentage of the land area in the contributing basin, based on the percentage of contributing 'I flow or an agreed upon percentage split. The decision was made to use an agreed upon cost '� share for the new sewer. This decision was based on the difficulty to prepare and ensure a fair and equitable cost distribution for either of the first two methods given the uncertainty as to the ultimate development of the vacant ground in the area.
