. , � � <br /> � , � . <br /> , �„ <br /> . <br /> INTERGOVERNMENTAL AGREEMENT <br /> BETWEEN THE SANITARY DISTRICT OF DECATUR, A MUNICIPAL <br /> CORPOR.ATION, AND THE CITY OF DECATUR, A HOME RULE MUNICIPAL <br /> CORPOR.ATION, BOTH OF MACON COUN'!'Y, ILLINOIS, FOR THE MAINTENANCE <br /> OF CERTAIN CITY OF DECATUR PUMP STATIO S <br /> THIS AGREEMENT made this ' ( ' day o 2 , between the <br /> Sanitary District of Decatur, a Municipal Corporation, Macon <br /> County, Illinois ( "DISTRICT" ) and the City of Decatur, a home <br /> rule Municipal Corporation, Macon County, Illinois ( "CITY" ) , <br /> WHEREAS, pursuant to Article VII, Section X of the 1970 <br /> Constitution of the State of Illinois, and the Illinois <br /> Intergovernmental Cooperation Act (5 ILCS 220/1 et seq. ) , units <br /> of local government in the State of Illinois may contract <br /> between themselves to obtain or share services and to exercise <br /> or combine functions which either units of the local government <br /> is authorized by law to perform; and, <br /> WHEREAS, the CITY agrees that the operation and maintenance <br /> of certain pump stations is necessary for the transportation of <br /> wastewater in the City of Decatur; and <br /> WHEREAS, the DISTRICT concurs that the effective <br /> maintenance and servicing of CITY owned pump stations is <br /> necessary to maintain the flow of wastewater to the Sanitary <br /> District of Decatur Treatment Plant; and <br /> WHEREAS, the CITY requests the DISTRICT to maintain certain <br /> CITY owned wastewater pump stations . <br />
