COUNCIL MEMORANDUM <br /> #2002-06 <br /> June 27, 2002 <br /> TO: The Honorable Mayor and City Council Members <br /> FROM: Steve G , City Manager <br /> John W. ter, Corporation Couns��.'�,� <br /> SUBJECT: ROUTE 36 EAST AND 44TH STREET DEVELOPMENT <br /> SUMMARY RECOMMENDATION: Staff recommends that Council approve the <br /> agreements between the City and CSX Railroad and between the City and Blackstone, both <br /> concerning the installation of railroad crossing protection devices at the crossing of the CSX <br /> tracks and 44th Street. <br /> BACKGROUND: Blackstone is currently attempting to develop the property located <br /> in the southeast quadrant of U.S. Route 36 and 44th Street. Development will require the <br /> signalization of that intersection, and that will require grade crossing protection devices for the <br /> CSX tracks located nearby. Blackstone has agreed to pay for the crossing devices. However, <br /> CSX has insisted that the work must be done by CSX under an agreement with the City. <br /> Therefore, the parties have agreed: (1) CSX and the City will enter an agreement for the <br /> installation of the devices, and (2) Blackstone and the City will enter another agreement whereby <br /> Blackstone will reimburse the City for the costs of the project. The City will have no liability. <br /> Assistant City Manager A.J. Krieger will be available to answer questions regarding this <br /> development. <br /> Attachments <br />
