The Department has instead
supplemented the agreements with the Illinois Public Labor
Relations Act (PLRA) , 5 111 . Comp. Stat. 315/17 (Formerly, Ch. 48;
Paragraph 1601 et. seq. ) .
In the event that dispute resolution procedures in the -
parties' current collective bargaining agreement are determined
not to be applicable to any interest dispute, the procedures in
the state law meet the requirements of the Federal Transit
Statute.
The ATU continues to object to the Department's previous
determinations which did not apply the interest arbitration
provision of the parties' October 8, 1973 Agreement. With
respect to the inclusion of the interest arbitration provision of
the parties' protective agreement, interest
arbitration is not required under 49 U.S.C. , Section 5333 (b) .
Further, appropriate alternative procedures are available under
the Illinois PLR.A in the absence of the parties' agreement to
utilize paragraph (9) of their October 8, 1973 protective
agreement.
As the parties are no doubt aware, Section 5333 (b) (2) (A) rights,
privileges and benefits are preserved under paragraph (2) of the
October 8, 1973 protective agreement. In the event that dispute
resolution procedures in the parties ' current collective
bargaining agreement are determined not to be applicable to any
dispute, the procedures in the state law meet the requirements of
the 49 U.S.C. , Section 5333 (b) .
