� • <br /> AMENDMENT TO THE AGREEMENT <br /> BETWEEN <br /> THE CITY OF DECATUR, ILLINOIS <br /> AND <br /> PROGRESSIVE TRANSPORTATION SERVICES, INC. <br /> This Amendinent to the Agreement is made and entered into by and between the CITY <br /> OF DECATUR, ILLINOIS, a municipal corporation hereinafter referred to as the"City", <br /> and PROGRESSIVE TRANSPORTATION SERVICES, Inc., a New York corporation <br /> authorized to do and doing business in the City of Decatur,hereinafter referred to as the <br /> "Manager". <br /> WHEREAS the City and the Manager entered into an Agreement, effective as of <br /> December 1, 1999, with an expiration date of June 30, 2001; and <br /> WHEREAS the Agreement between the City and the Manager specifies that"Three <br /> pre-priced option years may be exercised at the sole discretion of the City of Decatur"; <br /> and <br /> WHEREAS the City and the Manager exercised the first year option and extended the <br /> term of the Agreement to June 30, 2002; and <br /> WHEREAS the Citv and the Mana�er desire to exercise the second vear option and to <br /> extend the term of the Agreement to June 30, 2003; <br /> NOW THEREFORE, for and in consideration of the promises, covenants, agreements <br /> and conditions hereinafter set forth to be performed, kept and met by the respective <br /> parties hereto, the following Amendment to the Agreement is made. <br /> Section 3 of the Agreement shall be amended as follows: <br /> 3. Commencement and Term <br /> This Agreement shall be effective as of Deceinber 1, 1999 and shall reinain <br /> in effect for the period ending at 11:59 p.m. on June 30, 2003. One pre-priced <br /> option year may be exercised at the sole discretion of the City of Decatur. <br /> - 1 - <br />
