the Equipment on all tax assessments, returns and property renditions designating Lessee <br /> as the party to be taxed thereon. <br /> (d) Lessee will not sublet, mortgage, pledge, sell, assign, or otherwise encumber or dispose of <br /> Equipment or Lessee's interest therein. <br /> (e) Lessee will not remove, alter or deface Lessor's ownership plates, tags or identification of <br /> Equipment. <br /> 2. Lessor is to bear the expense of loading the Equipment at the original shipping point at the beginning <br /> of the rental period. <br /> 3. Lessee is to bear the entire cost of the following expenses: <br /> (a) Freight from shipping point to Lessee's destination. <br /> (b) Unloading, installation, startup, maintenance, and repair expenses. <br /> (c) Lessee, at its own expense and cost, shall keep the Equipment in good repair, condition and <br /> working order, and shall furnish any and all parts and labor required for that purpose. Lessee <br /> shall not make any material alterations to or replacements of the Equipment without the written <br /> consent of Lessor. All Equipment, accessories, parts and replacements which are added to or <br /> become attached to the Equipment shall immediately become the property of Lessor, and shall <br /> be deemed incorporated in the Equipment and subject to the terms of this lease as if originally <br /> leased thereunder. All costs of installation and operation of the Equipment shall be at the sole <br /> expense and cost of lessee. Lessor shall have no responsibility for the maintenance of the <br /> Equipment. Should the Equipment be stored or installed outdoors, Lessee shall provide <br /> adequate protection from the elements. All repairs, alterations,etc.shall be made in accordance <br /> with DEMA, NEMA, EGSMA, City and State Codes governing diesel electric generating sets. <br /> d) Lessee shall cause the Equipment to be installed and operated by capable, experienced and <br /> licensed engineers in accordance with the rules and regulations of all local, city, state, and <br /> federal laws governing said Equipment. <br /> (e) At expiration of the lease, Lessee is to disconnect and load Equipment on common carrier as <br /> directed by Lessor and pay return freight to Lessor's designated destination. <br /> 4. Regardless of the manner in which any part or all of the Equipment may be affixed to realty, the <br /> Equipment shall remain personal property. If the lessee is not the owner of the premises, Lessee shall <br /> provide Lessor with a Landlord's Waiver of Lien acceptable to Lessor. <br /> 5. This Equipment shall, at all times, remain the property of Lessor. At the end of the lease, the property <br /> shall be returned to Lessor in good operating condition, in order to pass internal, external and Ioad <br /> bank tests by a national insurance company and/or manufacturer of the Equipment. The cost of the <br /> inspection $ 600.00 is to be borne by Lessee. In the event of any damage whatsoever to the <br /> Equipment, Lessee shall then make immediate repairs to the damaged part or parts and shall assume <br /> all costs of repair.
