DEPARTMENT OF WATER MANAGEMENT
Memorandum No. 2002-01
January 10, 2002
TO: Honorable Mayor Howley and City Council
FROM: Steve Garman, City Manager
John A. Smith, Assistant City Manager for Public Services
Keith D. Alexander, Director of Water Management (
I
SUBJECT:
Dredge Sediment Storage Facility
Macon County Petition For Special Use Permit
SUMMARY RECOMMENDATION:
Council adopt the attached Resolution approving the Macon County Petition For Special Use
Permit.
BACKGROUND:
In order to reuse the dredge sediment storage facility located in Oakley Township, the City must
obtain a Special Use Permit from Macon County. Attached is a draft permit petition that staff
recommend be submitted to the County. Two County Board Members (David Wolfe and Ed
Yoder), the County Planning and Zoning Director (John Donovan), and the City's dredging
consultant (Homer L. Chastain & Associates, LLP) provided valuable assistance in drafting the
petition. Based on this assistance, staff believes that there are three not-to-be compromised items
that must be included in the petition in order to obtain County Board approval:
1. A Site Maintenance Advisory Committee will be created and consist of one
representative each from the Macon County Board, Oakley Township and the Macon
County Soil & Water Conservation District. Two representatives will be from the City of
Decatur. The Committee will operate as follows:
"When a concern or complaint regarding routine site maintenance is brought
to the Committee's attention, it shall be forwarded to the City's Water
Management Department within 10 business days. The City shall have 30
business days to resolve the matter to the satisfaction of the Committee. If
the matter is not resolved within the allotted time, the Committee may call a
special meeting to discuss and vote on a plan of action. Once a plan of
action has been agreed upon, the Committee shall have the authority to
arrange for a private contractor to perform the necessary routine site
maintenance. The work is to be performed by a pre-approved contractor.
The City will provide the Committee with a list of pre-approved contractors
