Newell, P.E., City Engineer�.E�Vt <br /> SUBJECT: Highway- Rail Crossing Agreement for Park 101 At-Grade Rail Crossings <br /> SUMMARY RECOMMENDATION: <br /> It is recommended by staff that the City Council approve the attached resolution authorizing an <br /> agreement between the City of Decatur and the Illinois Central Railroad Company covering the <br /> ongoing maintenance of the highway - rail crossings currently in place in the Park 101 industrial <br /> development on the northeast side of the City. <br /> BACKGROUND: <br /> In 1975, the City, Illinois Central Railroad, and the Park 101 Development Company entered into <br /> an agreement (attached) that provided for the following Highway - Rail Crossings (shown as <br /> Exhibits A and B in the original agreement): <br /> 1. The extension of Hubbard Avenue across the existing Illinois Central rail line that runs <br /> along the west side of Route 48,north of Pershing Road. <br /> 2. The extension of Rupp Parkway north of Hubbard Avenue across a then proposed <br /> extension of an Illinois Central rail spur. <br /> The original agreement allowed the City to obtain public crossing easements at both crossings. It <br /> also required the Developer (Park 101 Development Company) to reimburse the Railroad for all <br /> work completed to install the crossings and maintain them. <br />
