LEGAL DEPARTMENT MEMORANDUM
No. 2001-19
October 3, 2001
TO: Honorable Mayor and City Council Members
FROM: Steve Ga ity Manager
John W. C , Corporation Counsel
RE: Decatur Bu mess Center- Environmental Remediation
SUMMARY RECOMMENDATION: Council should approve a wark order
authorizing the closing of a water treatment facility at the Decatur Business Center.
BACKGROUND: Several years ago it was observed that there was some environmental
contamination present in the discharge of water from the Decatur Business Center site into an
adjoining creek. At that time, the several parties jointly investigating the site (and the adjoining
Zexel property) decided to install a facility to treat the water from this particular outfall before it
entered the creek. It has operated since that time, with the four parties (the City, Zexel, Mueller
and Borg Warner) sharing the cost.
It has now been determined by the parties' consultant that this facility is no longer
necessary (since the contamination is no longer present), and the parties wish to shut it down.
Staff concurs with that recommendation, and is forwarding to Council a resolution that would
approve a work order doing just that. The estimated cost of the City's share for shutdown is
$6,950.00. (The City is currently spending in excess of $4,000 per year for operation and
maintenance of the system.)
Staff recommends that this resolution be approved.
POTENTAIL OBJECTION: None of which City staff is aware.
STAFF REFERENCE: John Couter(424-2807);
JWC:ps
cc: Wendy L.
