R <br /> AGREEMENT II <br /> The City of Decatur, Illinois ("City"), a municipal corporation, and Decatur Memorial <br /> Foundation, an Illinois not for profit corporation, acting by and through its program commonly <br /> known as Decatur Community Partnership (Decatur Memorial Foundation hereafter referred to <br /> as "DCP") ,hereby agree as follows: <br /> 1. DCP shall organize and manage a program utilizing volunteers and volunteer <br /> organizations to assist individual citizens of the City of Decatur with the collection and disposal <br /> of leaves. Elderly and/or disabled citizens shall be given priority by DCP with regard to said <br /> program. <br /> 2. DCP may pay volunteer organizations for services rendered to said program by the <br /> members thereof, as deter�nined by DCP and such organizations. <br /> 3. DCP shall make all records of said program available for inspection by employees and <br /> agents of the City during regular business hours. <br /> 4. The City sha11 reimburse DCP for the expenses of said program, including but not <br /> limited to funds paid to volunteer organizations and funds expended for purchase of materials <br /> such as yazd waste bags. <br /> 5. The obligation of the City to reimburse DCP as set out in paragraph 4 hereof is <br /> expressly conditioned and limited, as follows: (a) in no event shall the City's obligation to DCP <br /> exceed Sixty-Two Thousand Dollars ($62,000.00) in total, and (b) DCP's right to reimbursement <br /> hereunder is not a claim against the full faith and credit of the City. <br /> 6. DCP shall submit a final report concerning said program on or before January 1, 2002. <br /> 7. DCP shall submit Certificates of Insurance to the City, with the City shown thereon as <br /> an additional named insured, and with such coverage and such policy limits as aze approved by <br /> the City's Risk Manager. <br /> 1 <br />
