This agreement creates a license only and District agrees that it will not at any <br /> time claim any interest or estate of any kind or extent whatsoever in this property by <br /> virtue of this license. <br /> 4. The District agrees, at its own expense, to do all necessary construction, <br /> maintenance and repair of the parking lot pursuant to the plans and specifications <br /> prepared by BGM Engineering, Inc. <br /> 5. The District agrees that Decatur shall not be responsible for any maintenance <br /> or safety in the operation of the parking lot. <br /> 6. The District agrees to protect, indemnify and save Decatur harmless from and <br /> against any liability or claims of any kind or character due to injury or death of any <br /> person or damage to any property arising out of the construction, maintenance or <br /> operation of the parking lot. <br /> 7. Decatur may temporarily interrupt the District's and the public's use of the <br /> licensed premises to repair and maintain the adjacent area. <br /> 8. Decatur reserves the right of ingress and egress over the premises subject to the <br /> license. <br /> 9. This agreement may be executed in counterparts, each of which shall be <br /> deemed to be an original and all of which shall together constitute one and the same <br /> instrument. <br /> IN WITNESS WHEREOF the parties have executed this agreement as of the day <br /> and year first above written. <br />
