July 31, 2001 <br /> COUNCIL COMMUNICATION FORM <br /> Engineering & Infrastructure Memorandum <br /> NO. 2001-45 '� <br /> TO: Honorable Mayor Howley and City Council 'I <br /> FROM: Steve Garman, City Manager <br /> Stephen Swanson, Director of Engineering&Infrastructur�� <br /> Matt Newell, City Engineer <br /> SUBJECT: Oakwood Street Lighting � <br /> SUMMARY RECOMMENDATION: <br /> It is recommended by staff that the City Council approve the attached resolution approving the <br /> termination of an agreement with Dynegy Energy Services, Inc. for the ownership and <br /> maintenance of the Oakwood Street Lighting; assigning the ownership and maintenance <br /> responsibilities to the City; assigning to the City from Dynegy other certain lighting agreements <br /> associated with Oakwood Street Lighting; and authorizing the Mayor to execute said termination <br /> and assignment agreement. <br /> BACKGROUND: <br /> The City in 1998 entered into an agreement with Illinova Energy Partners, Inc., for the Oakwood <br /> Lighting improvements consisting of 150 ornamental street lights. The area included in this <br /> agreement is shown on the attached drawing. The City paid $250,000 to Illinova for the design, <br /> construction and installation of the lights. In addition to the City's agreement, Illinova entered <br /> into separate agreements with eleven property owners for the cost of the lighting improvements. <br /> The eleven property owners are Millikin University; William T. Eichenauer; Jim & Kathy <br /> Gresham; Mason's AMOCO; Decatur Housing Authority; Northside Medical Building , <br /> Corporation; Chad Carver; Alpha Chi Omega Corporation; Beta Holding Corparation; Phi Beta <br /> House Corporation; and Illinois Delta House Corporation. <br /> The term of each agreement is for 40 years after which, unless extended, the street lighting would <br /> become subject to the franchise agreement in effect at that time or other agreement applicable to <br /> street lighting in the City. These agreements, including the City's agreement, are included as <br /> exhibits to the full termination and assignment agreement between Dynegy and the City. The <br /> agreements with private property owners have not been copied and included with the termination <br /> and assignment agreement attached to this memorandum. This was done to reduce the volume of <br /> material needing to be copied and forwarded to the City Council. The eleven separate <br /> agreements are on file with the City Clerk and available for viewing. There are approximately 38 <br /> years remaining on each agreement <br />
