:� . <br /> TIRE LEASE AGREEMENT <br /> This Agreement is made and entered into by and between the CITY OF DECATUR, ILLINOIS, <br /> a munici al co oration in the state of Illinois hereinafter referred to as the"CITY", and <br /> P rP <br /> , <br /> BRIDGESTONE/FIRESTONE, INC., an Ohio corporation with its principal offices in Akron, <br /> Ohio, hereinafter referred to as the"MANUFACTURER". Any proposed change in this <br /> Agreement shall be submitted to the City of Decatur for its prior approval. <br /> 1. TERM OF AGREEMENT <br /> This Agreement shall become and be effective as of July 1, 2001, and shall continue in effect <br /> through June 30, 2004. The CITY and the MANUFACTURER shall have the option to renew <br /> this contract for two, one-year periods, if mutually agreed, with the lease rate and other contract <br /> terms for the two option years to be determined by negotiation. <br /> 2. FINANCIAL ASSISTANCE <br /> This Agreement is subj ect to the funding and approval of the Federal Transit Administration <br /> (FTA) and the Illinois Department of Transportation(IDOT), and is subject to financial <br /> assistance contracts between the City of Decatur and the Illinois Department of Transportation <br /> and the US Department of Transportation, Federal Transit Administration. <br /> 3. COMMUNICATIONS <br /> For purposes of this agreement, all notices and other communications shall be addressed to the <br /> respective parties as follows: <br /> CITY MANUFACTURER <br /> The City of Decatur, Illinois Bridgestone/Firestone, Inc. <br /> 555 East Wood Street Mileage Sales Division <br /> Decatur, IL 62523 1200 Firestone Parkway <br /> Akron, Ohio 44317-0001 <br /> The persons to whom notices shall be addressed axe: <br /> • CITY: Paul McChancy,Mass Transit Administrator ' <br /> • MANUFACTURER: Dennis J. Mariola, General Manager <br /> No oral or electronic communication shall be considered to be official until and unless it is <br /> confirmed in writing. <br /> 4. SCOPE OF SERVICES <br /> The CITY agrees to lease from the MANUFACTURER, and the MANLTFACTURER agrees to <br /> lease to the CITY such number of tires of the sizes and types as may be sufficient and required to <br /> keep all of the CITY's transit coaches and trolley replica coaches fully equipped and to provide <br /> an adequate reserve supply; provided, however,that the CITY shall have the right, upon thirty <br /> (30) days written notice to the MANUFACTURER, to equip up to five percent(5%) of its <br /> coaches with tires obtained from other suppliers, for testing purposes. <br /> Decattirr Public Transit S��stem <br /> Tire Lease Agreement 1 <br />
