. , <br /> A LICENSE AGREEMENT - <br /> TO USE REAL PROPERTY BETWEEN <br /> ADELPHIA BUSINESS SOLUTIONS OF ILLINOIS, INC. <br /> AND THE CITY OF DECATUR, ILLINOIS <br /> Adelphia Business Solutions of Illinois, Inc., (hereinafter referred to as "Grantee"), is a <br /> Delaware corporation and is authorized to do business in the State of Illinois, and the City of <br /> Decatur, Illinois ("City"), is a municipal corporation organized under the laws of the State of <br /> Illinois. <br /> Section 1. Grant of Licenses. Location. For the good and valuable consideration <br /> specified herein, the Grantee is hereby given license upon the terms and subject to the conditions <br /> of this agreement, to install, maintain and use a conduit system ("System"), buried or aerial, <br /> above, within and under the public right-of-way, provided the Director of Engineering & <br /> Infrastructure has approved the plans and specifications therefor, with such approval not being <br /> , <br /> unreasonably withheld. An addendum to this license will be executed to describe the System, and <br /> will attach as Exhibit "A", which Exhibit may be subsequently modified, provided the Director <br /> of Engineering & Infrastructure has� approved the plans and specifications for any extension to <br /> the System, with such approval not being unreasonably withheld. Width of license described in <br /> this Section shall be ten (10) feet as measured typically from the right-of-way l�ne toward the <br /> street pavement. At street crossings, said license shall be projected at a straight line across or two <br /> at an angle of ninety degrees (90°). Refer to Exhibit "A" for license routing and offset <br /> dimensions. Grantee will provide City with plans and specifications as soon as such plans are <br /> available. <br /> Section 2. Term of Agreement. Subject to the conditions herein stated, the <br /> above-described uses of the public way shall exist by authority herein granted for a period of ten <br /> (10) years from and after the date of approval of this Agreement by the City. <br /> 142606_1.DOC <br />
