• i � <br /> AMENDMENT TO THE AGREEMENT <br /> BETWEEN <br /> THE CITY OF DECATUR, ILLINOIS <br /> AND <br /> PROGRESSIVE TRANSPORTATION SERVICES, INC. <br /> I�, This Amendment to the A eement is made and entered into b and between the CITY OF <br /> �' Y <br /> DECATUR, ILLINOIS, a municipal corporation hereinafter referred to as the"City", and <br /> PROGRESSIVE TRANSPORTATION SERVICES, Inc., a New York corporation authorized to <br /> do and doing business in the City of Decatur, hereinafter referred to as the "Manager". <br /> i <br /> WHEREAS the City and the Manager entered into an Agreement, effective as of December l, <br /> 1999, with an expiration date of June 30, 2001; and <br /> « <br /> WHEREAS the A eement between the Ci an he Mana r e ifie ee r - ' <br /> d t e s c s that Thr e nced <br /> �' tY g P P P <br />, option years may be exercised at the sole discretion of the City of Decatur"; and <br /> WHEREAS the City and the Manager desire to exercise one option year and to extend the term <br /> of the Agreement to June 30, 2002; and <br />� WHEREAS the Agreement between the City and the Manager specifies that the person furnished <br />' by the Manager to serve as the Resident Manager shall be Mr. Richard W. Coinmencement and Term <br /> This Agreement shall be effective as of December 1, 1999 and shall reinain in effect for <br /> the period ending at 11:59 p.m. on June 30, 2002. Two pre-priced option years may be <br /> exercised at the sole discretion of the City of Decatur. <br /> Subsection 4.b. of the Agreement shall be amended as follows: <br /> 4. Resident Mana�er <br /> b. Mr. Richard A. Foiles shall be the Resident Manager for the City of Decatur's <br />� mass transit system under this Agreement. Mr. Foiles shall not be transferred <br /> from this assigrunent without written permission fonn the City. Transfer of Mr. <br /> Foiles without the written approval of the City shall constitute a breach of the <br /> contract and shall be dealt with in accordance with Section 24 of this Agreement. <br /> If Mr. Foiles must be replaced as Resident Manager for any reason, the City shall <br />� have the right to approve his replacement. <br /> - 1 - ', <br />
