Newell, City Engineer � <br /> SUBJECT: Agreement with Amoco Oil Company, 1725 South Franklin Street <br /> SUMMARY RECOMMENDATION: <br /> It is recommended by staff that the City Council approve the attached resolution authorizing a <br /> Tiered Approach to Corrective-Action Objectives Agreement between the City and Amoco Oil <br /> Company and authorizing the Mayor to execute the Agreement. <br /> BACKGROUND: <br /> The City's Department of Engineering & Infrastructure was contacted by representatives of <br /> Amoco Oil Company about obtaining a Highway Authority Agreement in conjunction with <br /> Amoco's site remediation at 1725 S. Franklin Street. Amoco is undertaking a remediation effort <br /> as the result of a leaking underground storage tank(s). The estimated impacted area is outlined <br /> on the drawings attached to the agreement. <br /> Amoco has been coordinating this work with the Illinois Environmental Protection Agency <br /> (IEPA). Amoco desires to obtain a "No Further Remediation Letter" for their property from the <br /> IEPA. The IEPA has advised Amoco that an acceptable and recommended means to comply <br /> with the Site Remediation Program is to obtain institutional control of those properties impacted <br /> by the subsurface contaminants that are not in Amoco's ownership. <br /> The institutional control sought by Amoco is in the form of a deed restriction that will prohibit <br /> the City from allowing the groundwater under the identified area to be used as a potable or other <br /> domestic supply of water and will limit access into the soil by means of excavations. The area <br /> that Amoco is asking the City to place such a restriction on is the South Franklin Street and 1 st <br /> Drive right of way adjacent to their site. This area is delineated on a map attached to the <br /> proposed agreement. <br />
