I . � F. Energy Conservation. The Grantee and its third party contractors shall comply with mandatory standards and policies relating to energy efficiency that are contained in applicable state energy conservation plans issued in , compliance with the Energy Policy and Conservation Act,42 USC Section 6321 et se9. G Clean Water. Grantee agrees to comply with all applicable standards,orders,or regulations issued pursuant to the Federal Water Pollution Control Act, as amended, 33 USC Sec. 1251 et seq. ITEM 29-CHARTER SERVICE OPERATIONS Neither the Grantee nor any transit operator performing work in connection with this Project will engage in charter service operations, except as permitted by 49 USC §5323(d) and FTA regulations "Charter Service," 49 CFR Part 604. Any charter service agreement entered into under these regulations is incorporated into this Agreement by reference. The Grantee has signed the attached charter seroice certification,which is part of Exhibit F. ITEM 30-PRIVACY If a Grantee is to administer any systems of records,the Grantee agrees to comply with,ans assurs the compliance of its employees with, the information restrictions and other applicable requirements of 5 U.S.C. § 552a. The Grantee agrees to include these requirements in each contract and subcontract to administer any system of records on behalf of the FTA or Department financed in whole or in part with Federal assistance provided by FTA. ITEM 31 -AMENDMENT Except as provided for in ITEM 4,the Parties agree that no change or modification to this Agreement, or any Exhibits or Attachments hereto, shall be of any force or effect unless the amendment is dated, reduced to writing, executed by both parties, and attached to and made a part of this Agreement. No work shall be commenced and no costs or obligations incurred in consequence of any amendment to this Agreement or any attachments hereto unfess and until such amendment has been executed and made a part of this Agreement and the Approved Project Budget has been amended to conform thereto. ITEM 32 -TITLES The Parties agree that the titles of the items of this Agreement, hereinabove set forth, are inserted for convenience of . identification only and shall not be considered for any other purpose. ITEM 33 -SEVERABILITY ' The Parties agree that if any provision of this Agreement is held invalid for any reason whatsoever, the remaining li provisions shall not be affected thereby if such remainder would then continue to conform to the purposes,terms and I requirements of applicable law.
