approved by the CITY's Corporation Counsel, conditioned upon the construction of the Improvement in compliance with all <br /> of the terms and provisions of this Agreement within one (1) year from the date of recordation of the "Subdivision Plat" <br /> (defined in Section 5, below). The Bond shall be furnished prior to the approval of any subdivision of the Premises by the <br /> CITY. <br /> 4. Upon full execution of this Agreement, the CITY shall consider the proposed plat of subdivision (the "Subdivision PIaY')for <br /> the Premises, and shall expedite the review process therefor insofar as is reasonably possible; provided, however, that <br /> nothing in this Agreement shall be construed as waiving any requirement imposed by any statute, code, or ordinance <br /> regarding the subdivision of the Premises. Notwithstanding anything to the contrary contained herein, however, until such <br /> time as the Subdivision Plat has been accepted and recorded,JDN shali have no obligation to perform the Improvement. <br /> 5.
